How would I have handled it differently? I would have remembered that we are a nation of laws, and that the Animal Farm motto of "All are equal, but some are more equal than others" is an anethema to a nation of laws. If, in an open trial, where the accused has the right to confront his/her accuser, where the rules of evidence do not allow for second-hand testimony or that gathered through use of torture, the government cannot prove its case well enough to bring about conviction, then they had a pretty lousy case to begin with.
We have the Geneva Conventions because another nation decided it could simply declare a person an "enemy of the state", imprison and torture them, and allow them no legal recourse. If we would condemn the Nazis for what they did, we damn well had no business doing the same thing and claiming any moral high ground.
